Tax Advice for Wallapop and Vinted Sellers in Spain

The limits of 30 transactions and EUR 2,000 determine whether a seller of goods is excluded from that reporting. They are not a tax exemption and do not by themselves determine whether there is a business activity.
What DAC7 Means for Sales on Platforms
The DAC7 Directive sets identification and reporting duties for certain digital platform operators. In Spain, the corresponding information return is Modelo 238, filed by the platform operator rather than the seller. DAC7 does not create a new tax or by itself change how a sale is taxed.
What information does the AEAT receive?
- Full personal details (name, DNI/NIE, address)
- Total number of sales during the year
- Total sales amount
- Fees paid to the platform
- Financial account identifier, where applicable
- Consideration and transaction information by period
When may information be reported?
For sales of goods, reporting excludes a seller for whom the operator facilitated:
- Fewer than 30 transactions during the period, and
- A total amount that does not exceed EUR 2,000
Both conditions must be met for the reporting exclusion. Reaching these thresholds does not automatically turn sales into a business activity, and remaining below them does not remove a tax duty arising for another reason.
Must I Register as Self-Employed in Spain?
The answer depends on what you sell and how you organise the activity. Having another job or earning less than Spain's minimum wage does not automatically exclude RETA registration.
Occasional sale of personal belongings
In principle, it is not a trading business when:
- You sell items from your personal assets
- The transactions are occasional
- You do not buy goods with the intention of reselling them
Selling below acquisition value will usually produce a non-deductible capital loss when it results from personal consumption. Selling above that value may produce a capital gain that must be reported for Spanish personal income tax (IRPF).
Trading as a business activity
There are signs of a business activity when you habitually operate on your own account, for example:
- You buy products to resell for profit
- You maintain stock, advertising or an organised operation
- You make continuing sales within that organisation
In that case, tax registration through Modelo 036, the applicable tax returns and RETA registration must be assessed. Spanish Social Security defines self-employment by its personal, direct and habitual nature, regardless of income.
REBU for Trading in Used Goods
Spain's Special Scheme for Used Goods (REBU) governs VAT for resellers of certain used goods, works of art, antiques and collectors' items. Its application depends on the type of item, who supplied it and the conditions of each transaction.
How Does REBU Work?
When REBU is applied transaction by transaction, VAT is included in and must be extracted from the margin. This example compares a final selling price of EUR 150 at 21%, before other costs and taxes:
General VAT scheme:
- Item purchase: EUR 100
- Final selling price: EUR 150
- VAT included: EUR 26.03 (150 × 21 / 121)
- Margin after that VAT: EUR 23.97
REBU per transaction:
- Item purchase: EUR 100
- Final selling price: EUR 150
- VAT-inclusive margin: EUR 50
- VAT amount: EUR 8.68 (50 × 21 / 121)
- Margin after that VAT: EUR 41.32
The VAT difference in this example is EUR 17.35. This does not mean REBU can be freely chosen for any purchase: its conditions must first be met.
Conditions for Applying REBU
- The goods must be used items, antiques or collectors' items
- You must act as a reseller acquiring goods for resale
- The goods must come from a supplier permitted by the rules, such as a private individual or certain businesses where VAT on the supply is not deductible
- You must retain the required purchase and sales records
- The option to apply the general VAT scheme must be reviewed under the transaction and REBU rules

What Happens if I Do Not Declare My Sales?
If a sale produces a capital gain or forms part of a business activity, omitting the corresponding duties may lead to a tax adjustment. DAC7 is a source of information for the tax authority, not the origin of the duty to pay tax.

- A late return filed without a prior request may incur an initial surcharge of 1%, plus another 1% for each complete month of delay
- After 12 months, the surcharge is 15% and interest is added from that point
- If the AEAT has issued a request and there is a culpable failure to pay, the penalty may range from 50% to 150% of the unpaid amount

- The consequences depend on the amount, the conduct and the circumstances
- Tax evaded above EUR 120,000 per tax and period may fall within the Spanish tax offence rules
- Voluntary correction and its timing may be relevant
